"The break fees will most probably not apply as you have investors etc lined up. This is really for when no money arrives, and we need to dismantle the whole structure.
For the minimum size the standard is that this is charged against the Initiator. In your case you mention that the performance will be as such that this is higher, and we will in any case setup a cost-take-over agreement between the initiator and the product. Now bearing in mind that you mention very high returns, charging against the return is no issue, but what if returns do not materialize? In such a case we need to have the possibility to not damage the investors. I trust you understand that. "
